By accessing or using Whirl ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.
Description of Service
Whirl is an AI-powered interview practice platform that provides simulated interview experiences, feedback, and analytics to help users prepare for job interviews.
User Accounts
To access certain features, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
You must provide accurate, complete, and current information when creating your account.
Subscription and Payments
Free Tier
The free tier provides unlimited text-based interview practice with basic features at no cost.
Pro Subscription
Pro subscriptions are billed monthly or annually. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
Free Trial
We may offer free trials of Pro features. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription.
Cancellation and Refunds
You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. We offer a 30-day money-back guarantee for new subscribers.
Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Share your account with others
- Upload malicious content or malware
- Use the Service to harass or harm others
- Reverse engineer or attempt to extract source code
- Use automated systems to access the Service without permission
Intellectual Property
The Service, including its original content, features, and functionality, is owned by Whirl and protected by copyright, trademark, and other laws.
You retain ownership of content you upload (resumes, responses). By uploading content, you grant us a license to use it to provide and improve the Service.
AI-Generated Content
Interview questions, feedback, and suggestions are generated by AI. While we strive for accuracy, we do not guarantee that AI-generated content is error-free or suitable for any specific purpose. The Service is for practice only and does not guarantee interview success.
Video Recording
Video recording features require your explicit consent. By enabling recording, you:
- Consent to the recording of your video and audio
- Agree that recordings are stored according to our Privacy Policy
- Understand that recordings are only accessible to you
Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
Interview practice scores and feedback are for educational purposes only and do not represent any guarantee of actual interview performance.
Limitation of Liability
To the maximum extent permitted by law, Whirl shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
Indemnification
You agree to indemnify and hold harmless Whirl from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
Modifications to Service
We reserve the right to modify or discontinue the Service at any time, with or without notice. We will not be liable for any modification, suspension, or discontinuation.
Changes to Terms
We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles.
